Mox Referral Programme 3 (the “Referral Programme 3”) terms and conditions

1.
These Referral Programme 3 terms apply to the promotion offered by Mox Bank Limited and its affiliates (“Mox”). By participating in the Referral Programme 3, you agree to these terms.
2.
You must read these terms along with Mox’s Personal Information Collection Statement, Privacy Policy Statement, General Terms and Conditions and any other terms we may provide to you. These terms apply in addition to any such terms.
3.
If there is any inconsistency between these terms and any of the other Mox terms, these Referral Programme 3 terms will prevail.
4.
The Referral Programme 3 will begin on 1 November 2021 and end on 31 December 2021 (both dates inclusive) (the “Promotion Period”). Mox may change the Promotion Period at any time in its absolute discretion.
5.
During the Promotion Period, an individual who already has a valid Mox Account opened in their name (the “Referrer”) will be provided a unique Referral Programme 3 code (an “Invitation Code”) by Mox via the "Discover" page in the Mox app for completing a “Successful Referral” (defined below).
6.
A “Successful Referral” occurs when the following conditions are satisfied:
During the Promotion Period:
a)
a Referrer provides his/her Invitation Code to an individual who has never held a Mox Account in their name (a “Referee”);
b)
the Referee downloads the Mox app and applies for a Mox Account using the Referrer’s Invitation Code and (if applicable) applies for Mox Credit at that same time or otherwise prior to settlement of their Successful Purchase Transaction(s) (defined below);
c)
Mox notifies the Referee that their Mox Account has been successfully opened (and their digital Mox Card is ready to use) (the “Account Opening Date”);
During the period from the Account Opening Date and the following 30 days:
d)
the Referee spends at least HKD200 in aggregate on their Mox Card (digital or physical, from their Mox Account or (if applicable) with Mox Credit) across one, or many, “Successful Purchase Transaction(s)”.
Successful Purchase Transaction(s) are ultimately determined by Mox in its absolute discretion based on transaction records held by Mox (which are final and conclusive in case of any discrepancy). The following are some examples of transactions that do not constitute Successful Purchase Transaction(s): cash withdrawals, money transfers via the Mox app and invalid, cancelled, refunded or reversed transactions. Successful Purchase Transactions do not need to have ‘settled’ (i.e., appear as ‘completed’ in the Mox app) during the 30-day period following the Account Opening Date for a Successful Referral to occur (i.e. they can still appear as ‘pending’ in the Mox app).
7.
Following a Successful Referral, each of the Referrer and the Referee will be eligible to receive a cash reward (a “Reward”) from Mox according to the table below:

* A Referee’s Mox Credit application must be submitted to Mox at the time they applied for a Mox Account using the Referrer’s Invitation Code or otherwise prior to settlement of their Successful Purchase Transaction(s). Such Referees will be eligible for a Reward in accordance with this column irrespective of their Mox Credit application outcome.
8.
Following a Successful Referral, each of the Referrer and the Referee will be eligible to receive a cash reward (a “Reward”) from Mox according to the table below:
a)
Mox has determined that a Successful Referral has taken place; and
b)
the Successful Purchase Transaction(s) with an aggregate value of at least HKD200 have ‘settled’ in the Referee’s Mox Account (i.e. appear as completed in the Referee’s Mox app) per Mox’s transaction records (which are final and conclusive in case of any discrepancy).
9.
Each of the Referrer and the Referee is only eligible to receive a Reward if:
a)
the Referee has never held a Mox Account in their name at any time prior to the opening of their Mox Account using the Invitation Code (irrespective of whether the Referee completed any transactions on their prior Mox Account);
b)
the Referee has never previously received a Reward or been a Referee. A Referee who has been successfully referred by a Referrer cannot be referred by any other Referrer. That Referee can however become a Referrer themselves if they choose. In this respect, Mox’s records are final and conclusive in case of any discrepancy;
c)
each of the Referrer and the Referee holds a valid Mox Account in their respective name when Mox attempts to pay a Reward, with neither Mox Account having been suspended or closed by the Referrer or Referee (as applicable) or Mox or in arrears or default; and
d)
the Successful Participant meets any additional requirements communicated by Mox, such as any requirements specified in connection with Referral Programme 3.
10.
Subject to these terms, including satisfaction of any requirements specified by Mox in connection with Referral Programme 3, Mox will continue to pay Rewards to eligible Referrers and Referees after the Promotion Period has ended.
11.
A Referee can only participate in the Referral Programme 3 once. Neither participation in the Referral Programme 3 by a Referrer or a Referee nor eligibility for any Reward may be transferred, exchanged or converted into any other benefit or right.
12.
Mox reserves the right, at any time without notice or reason and in its sole discretion, to:
a)
change, modify, suspend or terminate the Referral Programme 3 or these terms (including any Reward and their monetary value);
b)
refuse to offer or distribute a Reward to any Referrer or Referee if Mox believes a Mox Account has been opened for an improper purpose (for example attempting to secure payment of a Reward by closing and opening one or more Mox Accounts) or for any other reason Mox deems appropriate;
c)
make any decision in connection with the Referral Programme 3 (including to refuse or suspend a Referrer’s or Referee’s participation in the Referral Programme 3, determine whether a Reward can or cannot be combined with any other offer or promotion offered by Mox); and
d)
determine that an Invitation Code has been used for an improper purpose and cancel the use of any such Invitation Code.
Any such decision shall be conclusive and binding on a Referrer or Referee (as applicable).
13.
If any dispute arises in connection with the Referral Programme 3, Mox’s decision is final.
14.
To the extent permitted by laws and regulations, each Referrer and Referee shall release Mox from all actions, proceedings and claims which may be brought by or against Mox or its affiliates, arising from or in connection with his/ her participation in the Referral Programme 2 (including any failure to receive a Reward or metal Mox Card Reward) or these terms, unless due to Mox’s or its affiliates’ gross negligence, fraud or wilful default and only to the extent of direct and reasonably foreseeable loss and damage arising directly and solely from such gross negligence, fraud or wilful default. This release continues after the termination of these terms or the expiry of the Promotion Period.
15.
A person who is not a party to these terms has no rights to enforce or enjoy the benefit of any of their provisions under the Contracts (Rights of Third Parties) Ordinance (Cap. 623). This does not apply to the Referee or as otherwise set out in these terms.
16.
The Referral Programme 3 does not constitute an offer, invitation or recommendation to any person to enter into any transaction described in these terms or any similar transaction. Nothing under these terms or the Referral Programme 3 will deem, imply or suggest that a Referrer (or any other person or entity) is acting as an agent or representative of Mox or otherwise soliciting business on behalf of Mox.
17.
These terms are governed in all respects by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
18.
The English version prevails if there is any discrepancy or inconsistency between the English and Chinese versions of these terms.

To borrow or not to borrow? Borrow only if you can repay!
