If there is any inconsistency between these terms and any of the other Mox terms, these terms will prevail.
The dates of the promotion period for the Programme are set out in clause 23 of these terms (the
“Promotion Period”). Mox may change the Promotion Period at any time in its absolute discretion.
An individual who already has a valid Mox Account open in his/her name (the “Referrer”) will be provided a unique invitation code (an “Invitation
Code”) by Mox via the ‘Discover’ page in his/her Mox app that can be used by a Referee (as defined below) during the Promotion Period for completing a Successful Referral (as defined below).
A “Successful Referral” occurs when the following conditions (a), (b), (c) and (d) are satisfied during the below specified periods:
During the Promotion Period:
a Referrer provides his/her Invitation Code to an individual who has never held a Mox Account in their name (a “Referee”);
that Referee downloads the Mox app and applies for a Mox Account and (if applicable) Mox Credit using the Referrer’s Invitation Code; and
Mox notifies the Referee that his/her Mox Account has been successfully opened (and his/her digital Mox Card is ready to use) (the “Account Opening Date”);
During the period from the Account Opening Date and the following 30 days:
the Referee spends (in aggregate) with his/her Mox Card (digital or physical), either:
(if the Referee has been approved for Mox Credit during the period from the Account Opening Date and the following 30 days) at least the HKD amount as displayed in the table in clause 24 of these terms across one, or many Successful Purchase Transaction(s) with Mox Credit (the “Mox Credit Spend Requirement”); or
at least the HKD amount as displayed in the table in clause 25 of these terms across one, or many Successful Purchase Transaction(s) from their Mox Account (the “Mox Account Spend Requirement”).
Successful Purchase Transaction(s) are ultimately determined by Mox in its absolute discretion based on transaction records held by Mox (which are final and conclusive in case of any discrepancy). The following are some examples of transactions that do not constitute Successful Purchase Transaction(s): cash withdrawals, money transfers via the Mox app and invalid, cancelled, refunded or reversed transactions. Successful Purchase Transactions do not need to have ‘settled’ (i.e., appear as ‘completed’ in the Mox app) during the 30-day period following the Account Opening Date for a Successful Referral to occur (i.e. they can still appear as ‘pending’ in the Mox app).
Subject to these terms (including clause 6 above), following a Successful Referral, each of the Referrer and the Referee will be eligible to receive one cash reward
(a “Reward”) from Mox according to the table in clause 26 of these terms.
Except as otherwise set out in clause 26 of these terms, the Reward will be paid into each of the Referrer’s and the Referee’s Mox Account by Mox within 30 days after:
Mox has determined that a Successful Referral has taken place. In this respect, whether a Successful Referral has taken place, and the number of, Successful Referrals a Referrer has completed is ultimately determined by Mox in its absolute discretion based on referral records held by Mox (which are final and conclusive in case of any dispute); and
the first Successful Purchase Transaction(s) made by the Referee which count towards the Mox Credit Spend Requirement or the Mox Account Spend Requirement (as applicable) corresponding to the Successful Referral have ‘settled’ in the Referee’s Mox Account or with Mox Credit (as applicable) (i.e. appear as completed in the Referee’s Mox app) per Mox’s transaction records (which are final and conclusive in case of any discrepancy).
For the avoidance of doubt, the Reward the Referee is eligible to receive will depend on which Successful Purchase Transaction(s) settle first. In this respect:
if Successful Purchase Transaction(s) made by the Referee which count towards the Mox Credit Spend Requirement settle before Successful Purchase Transaction(s) which count towards the Mox Account Spend Requirement, only the Reward referrable to the completion of Mox Credit Spend Requirement will be awarded to the Referee; and
if Successful Purchase Transaction(s) made by the Referee which count towards the Mox Account Spend Requirement settle before Successful Purchase Transaction(s) which count towards the Mox Credit Spend Requirement, only the Reward referrable to the completion of Mox Account Spend Requirement will be awarded to the Referee.
In addition, if the Referee meets both the Mox Credit Spend Requirement and the Mox Account Spend Requirement during the period from the Account Opening Date and the following 30 days, the Referee and Referrer will not receive the Reward twice.
A Referee can only participate in the Programme as a Referee once.
Each of the Referrer and the Referee is eligible to receive the Reward only if:
a Referee has never held a Mox Account in their name at any time prior to the opening of their Mox Account using the Invitation Code (irrespective of whether the Referee completed any transactions on their prior Mox Account);
the Referee has never previously received the Reward or been a Referee. A Referee who has been successfully referred by a Referrer cannot be referred by any other Referrer. That Referee can however become a Referrer him/herself if he/she chooses to. In this respect, Mox’s records are final and conclusive in case of any discrepancy;
each of the Referrer and the Referee holds a valid Mox Account in their respective name when Mox attempts to pay the Reward, with neither Mox Account having been suspended or closed by the Referrer or Referee (as applicable) or Mox or in arrears or default; and
each of the Referee and the Referrer meets any additional requirements applicable to he/she communicated by Mox, such as any requirements specified in connection with the Programme.
Subject to these terms, including satisfaction of any requirements specified by Mox in connection with the Programme, Mox will continue to pay Rewards to eligible Referrers and Referees after the Promotion Period has ended.
Neither participation in the Programme by a Referrer or a Referee nor eligibility for any Reward may be transferred, exchanged or converted into any other benefit or right.
Mox reserves the right, at any time without notice or reason and in its sole discretion, to:
change, modify, suspend or terminate the Programme or these terms (including any Reward and its monetary value);
refuse to offer or distribute the Reward to any Referrer or Referee if Mox believes a Mox Account has been opened for an improper purpose (for example attempting to secure payment of the Reward by closing and opening one or more Mox Accounts) or for any other reason Mox may determine;
make any decision in connection with the Programme (including to refuse or suspend a Referrer’s or Referee’s participation in the Programme, determine whether the Reward can or cannot be combined with any other offer or promotion offered by Mox); and
determine that an Invitation Code has been used for an improper purpose and cancel the use of any such Invitation Code.
Any such decision shall be conclusive and binding on a Referrer or Referee (as applicable).
If any dispute arises in connection with the Programme, Mox’s decision is final.
To the extent permitted by laws and regulations:
Mox, its affiliates and shareholders shall not be responsible for any loss suffered by any Referrer or Referee; and
each Referrer and Referee shall release Mox from all actions, proceedings and claims which may be brought by or against Mox or its affiliates,
arising from or in connection with his/her participation in the Programme (including any failure to receive the Reward) or these terms, unless due to Mox’s or its affiliates’ gross negligence, fraud or wilful default and only to the extent of direct and reasonably foreseeable loss and damage arising directly and solely from such gross negligence, fraud or wilful default.
This clause 16 continues after the termination of these terms or the expiry of the Promotion Period.
A person who is not a party to these terms has no rights to enforce or enjoy the benefit of any of their provisions under the Contracts (Rights of Third Parties) Ordinance (Cap. 623). This does not apply to the Referee or as otherwise set out in these terms.
The Programme does not constitute an offer, invitation or recommendation to any person to enter into any transaction.
Nothing under these terms or the Programme will deem, imply or suggest that a Referrer (or any other person or entity) is acting as an agent or representative of Mox or otherwise soliciting business on behalf of Mox.
These terms are governed in all respects by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
The English version prevails if there is any discrepancy or inconsistency between the English and Chinese versions of these terms.
