Mox Bonus Promotion Terms and Conditions
1.
These terms apply to the Promotion offered by Mox Bank Limited (“Mox”, “we”, “us”). By participating in the Promotion, you agree to these terms.
2.
You must read these terms along with Mox’s Personal Information Collection Statement, Privacy Policy Statement, General Terms and Conditions and any other terms we may provide to you. These terms apply in addition to any such other terms, and the use of your Mox Card and account(s) will remain subject to our other terms.
3.
If there is any inconsistency between these Mox Bonus Promotion terms and any of our other terms, these Mox Bonus Promotion terms will prevail.
4.
The Mox Bonus Promotion runs from 1 September 2021 until 30 November 2021 (both dates inclusive) (“Promotion Period”). We may change the Promotion Period at any time in our absolute discretion. (Please note that we extended the original Promotion Period by one month to run until 30 November 2021.)

To be eligible to participate in the Mox Bonus Promotion, you must successfully complete both the “Monthly Spending Challenge” and the “Daily Deposit Challenge” (each as defined below) in accordance with these terms during a “Challenge Period”. The first Challenge Period will run from 1 September 2021 until 30 September 2021 (both dates inclusive). The second Challenge Period will run from 1 October 2021 until 31 October 2021 (both dates inclusive). The third Challenge Period will run from 1 November 2021 until 30 November 2021 (both dates inclusive). We may change the dates for a Challenge Period, or add subsequent Challenge Period(s), at any time in our absolute discretion.

To complete the “Monthly Spending Challenge”, you must successfully make “Eligible Card Transaction(s)” (as defined below) with your Mox Card (digital or physical, spending from your Mox Account or with Mox Credit) with a total cumulative settled amount of at least HKD4,000 during a Challenge Period. For the avoidance of doubt, Eligible Card Transaction(s) that show as ‘pending’ in the Mox app (i.e. they have been authorized but not settled) will not be counted towards the HKD4,000 spending requirement – only those that show as ‘completed’ in the Mox app will be counted.
“Eligible Card Transaction(s)” are ultimately determined by us in our absolute discretion based on transaction records held by us (which are final and conclusive in case of any discrepancy). Examples of Mox Card transactions that are not considered as Eligible Card Transaction(s) are the same as those not eligible for CashBack – see clause 6.5(b) in Schedule 1 to the General Terms and Conditions (Terms and conditions for accounts and card management).

To complete the “Daily Deposit Challenge” during a Challenge Period, you must have a deposit balance of at least HKD50,000 held with Mox (i.e. across your Mox Account and any Goal account(s)).

We will determine whether you have successfully completed the Monthly Spending Challenge and/or the Daily Deposit Challenge during a Challenge Period as of 23:59:59 Hong Kong time on each day of that Challenge Period (other than the last day of that Challenge Period – i.e. you will not be eligible to earn interest at the Bonus Rate (defined below) if the first time you complete the Monthly Spending Challenge and the Daily Deposit Challenge is on the last day of a Challenge Period or subsequently).

Once we have determined that you have completed both the Monthly Spending Challenge and the Daily Deposit Challenge per clause 8 above (the “Completion Day”), you will be eligible to earn interest at the “Bonus Rate” (on top of the interest you will earn at the “Base Rate”). The “Bonus Rate” is equal to a 0.5% p.a. Hong Kong Dollar savings rate applied on up to HKD500,000 of your total deposit balance held with us. The “Base Rate” is the Hong Kong Dollar savings rate that you will earn without completing the Monthly Spending Challenge or Daily Deposit Challenge applied on up to HKD500,000 of your total deposit balance held with us, which can be found on our website or on the Mox app.
10.
The interest at the Bonus Rate will be calculated on a 365-day year basis, based on your eligible deposit balance held with us as at 23:59:59 Hong Kong time on the day after the Completion Day (provided that day is within the relevant Challenge Period).
11.
Interest earned at the Bonus Rate will be credited by us to your account(s) with Mox two days after the Completion Day, and going forward during a Challenge Period daily for so long as we determine you have successfully completed both the Monthly Spending Challenge and the Daily Deposit Challenge during that Challenge Period (but only ever until the day after the last day of that Challenge Period), and always together with the relevant interest earned at Base Rate.
12.
Once we determine you have successfully completed the Monthly Spending Challenge during a Challenge Period, it will be complete for the remainder of that Challenge Period. However, once we have determined that you have successfully completed the Daily Deposit Challenge during a Challenge Period, you are required to continue to complete the Daily Deposit Challenge (in accordance with clause 7 of these terms) for the remainder of that Challenge Period in order to be eligible to earn the interest at the Bonus Rate for the remainder of that Challenge Period. Therefore, once you have successfully completed the Monthly Spending Challenge, your eligibility to earn interest at the Bonus Rate during a Challenge Period can start, stop and re-start, depending on whether you have successfully completed the Daily Deposit Challenge on a particular day of that Challenge Period as determined by us in accordance with clause 8 of these terms.
13.
For the avoidance of doubt, but subject to these terms, the Completion Day cannot fall on the last day of a Challenge Period and the last day we will credit any interest at the Bonus Rate to your account(s) with Mox after a Completion Day during a Challenge Period is one day after the last day of that Challenge Period.
14.
You must not do any of the following things before we credit interest at the Bonus Rate to your account(s) with Mox:
a. terminate your relationship with us; or
b. cause any account you have with us to be in arrears, suspension or default.
15.
We reserve the right, at any time, without notice or reason and in our sole discretion, to:
a. change, modify, suspend or terminate the Mox Bonus Promotion or these terms;
b. refuse to offer or pay you interest at the Bonus Rate for any reason we deem appropriate; and
c. make any decision in connection with the Mox Bonus Promotion (including to refuse or suspend your participation in the Mox Bonus Promotion or determine whether the Mox Bonus Promotion can or cannot be combined with any other offer or promotion offered by us).
Any such decision shall be conclusive and binding on you.
16.
If any dispute arises in relation to the Mox Bonus Promotion, our decision is final.
17.
You can only participate in the Mox Bonus Promotion once. Neither your participation in the Mox Bonus Promotion nor your eligibility to earn interest at the Bonus Rate may be transferred to assigned to any other person or exchanged or converted into any other benefit or right.
18.
To the extent permitted by laws and regulations, you shall release us and our affiliates from all actions, proceedings and claims which may be brought by or against us or our affiliates arising from or in connection with your participation in the Mox Bonus Promotion (including any decision not to offer or pay you interest at the Bonus Rate) or these terms, unless due to our gross negligence, fraud or wilful default and only to the extent of direct and reasonably foreseeable loss and damage arising directly and solely from such gross negligence, fraud or wilful default. This release continues after the termination of these terms or the expiry of the Promotion Period.
19.
The Mox Bonus Promotion does not constitute any offer, invitation or recommendation to any person to enter into any transaction described in these terms or any similar transaction.
20.
A person who is not a party to these terms has no rights to enforce or enjoy the benefit of any of their provisions under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) other than as set out in these terms.
21.
These terms are governed in all respects by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
22.
The English version prevails if there is any inconsistency between the English and Chinese versions of these terms.
